PM 01-07-10-d: Dismissal Due to Nonappearance

WAG 01-07-10-d.

The appeal is dismissed by the hearing officer if the client or their representative:

fails to appear at the time and place set for the hearing and a postponement has not been granted, or

refuses to proceed with the hearing and a continuance is not granted.

The Bureau of Assistance Hearings notifies the client or representative of the dismissal and sends a copy of the notice to the Family Community Resource Center.

When an appeal is dismissed, make any planned changes in benefits at once . Do not wait for the written decision from BAH.
